Terms of Use

Asian Institute of Nephrology and Urology Private Limited and its subsidiaries (collectively referred to as “we”, “us”, “AINU Group”) is the author and publisher of the internet resource www.ainuindia.org and its subdomains, including my.ainugroup.com (together referred to as “Websites”), as well as other connected software and applications provided by AINU Group, including but not limited to the mobile applications (referred to as “App”, and together with Websites referred to as “Services”). AINU Group provides the Services in partnership with its agents, affiliates, associates, representatives, or other third parties (together referred to as “Partners”). We aim to provide seamless healthcare services through WhatsApp while ensuring the utmost security and confidentiality of your personal data. These terms and conditions govern the use, storage, and handling of customer data in compliance with Indian healthcare industry laws.

1. Nature and Applicability of Terms

You are required to carefully review these terms and conditions (“Terms”) and the privacy policy available at Privacy Policy before accessing the Website or App or utilizing the Services provided by AINU Group. By accessing the Website or App or using the Services, you agree to be bound by these Terms and the Privacy Policy, which together form a legal agreement (“Agreement”) between you and AINU Group concerning your visit to the Website and your use of the Services. This Agreement also incorporates our commitment to comply with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”), and the (Indian) Information Technology (Intermediaries Guidelines) Rules, 2011 (the “IG Rules”), Digital Personal Data Protection Act, 2023 (DPDP Act) and any other applicable data protection legislation, ensuring that your personal data is handled in accordance with the law.

Please carefully review these terms and conditions (“Terms”) and the privacy policy available at Privacy Policy before accessing the Website or App or using the Services provided by us. These Terms and the Privacy Policy together constitute a legal agreement (“Agreement”) between you and AINU Group regarding your visit to the Website and use of the Services (as defined below). If you do not agree with these terms, please refrain from using our services.

The Agreement applies to you whether you are:

1. A patient, his/her representatives/attendant/relative/friend or affiliates (“you” or “User”); or

2. A user of the Website or App (“you” or “User”).

This Agreement applies to all services provided by AINU Group on the Website or App.

Services may change from time to time at the sole discretion of AINU Group, and the Agreement will apply to your visit to and use of the Website or App to avail the Service, as well as to all information provided by you on the Website or App at any given time.

This Agreement defines the terms and conditions under which you are allowed to use the Website and App and describes how we will treat your account while you are registered with us. If you have any questions about any part of the Agreement, feel free to contact us at contactus@ainuindia.com.

By downloading or accessing the App or Website to use the Services, you irrevocably accept all terms and conditions stipulated in this Agreement and agree to fully abide by them.

This Agreement supersedes all previous oral and written terms and conditions (if any) communicated to you. By availing of any Service, you signify your agreement and acceptance of this Agreement.

We reserve the right to modify or terminate any portion of the Agreement for any reason and at any time. You should read the Agreement at regular intervals. Your use of the App or Website following any such modification constitutes your agreement to follow and be bound by the modified Agreement. Any additional terms and conditions, disclaimers, privacy policies, and other policies applicable in general and/or to specific areas of this Website or to particular Service are also considered part of the Agreement.

You acknowledge that you will be bound by this Agreement for availing any of the Services offered by us. If you do not agree with any part of the Agreement, please do not use the Website or avail of any Services.

Your access to and use of the Website and the Services will be solely at the discretion of AINU Group. The Agreement is published in compliance with, and is governed by the provisions of Indian law, including but not limited to:

1. The Indian Contract Act, 1872,

2. The (Indian) Information Technology Act, 2000, and

3. The rules, regulations, guidelines, and clarifications framed thereunder, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”), and the (Indian) Information Technology (Intermediaries Guidelines) Rules, 2011 (the “IG Rules”), Digital Personal Data Protection Act, 2023 (DPDP Act).

2. Conditions of Use

You must be 18 years of age or older to register, use the Services, or visit or use the Website in any manner. By registering, visiting, and using the Website or accepting this Agreement, you represent and warrant to AINU Group that you are 18 years of age or older, and that you have the right, authority, and capacity to use the Website and the Services available through the Website, and agree to and abide by this Agreement.

3. End-User Account and Data Privacy

a) Definitions: The terms “personal information” and “sensitive personal data or information” are defined under the SPI Rules and are reproduced in the Privacy Policy.

b) Information Collection: AINU Group and its Partners may collect information relating to the devices through which you access the Website, your location, and anonymous data of your usage. This information will be used to improve the quality of the Services and to develop new services.

c)Following data will be collected:

We collect personal information necessary to provide you with healthcare services. This may include, but is not limited to:

  • Name
  • Phone number
  • Email address
  • Medical history
  • Prescriptions
  • Diagnostic reports
  • Credit card number
  • Cardholder name
  • Card expiration date

d) Communication: The Website and App allow AINU Group and its Partners to access Users’ personal email or phone number for communication and analytics purposes.

e) Privacy Policy: The Privacy Policy sets out:

  • The type of information collected from Users, including sensitive personal data or information
  • The purpose, means, and modes of usage of such information
  • How and to whom AINU Group will disclose such information
  • Other information mandated by the SPI Rules

f) User Responsibility: You are expected to read and understand the Privacy Policy to ensure you are aware of:

  • The fact that certain information is being collected
  • The purpose for which the information is being collected
  • The intended recipients of the information
  • The nature of collection and retention of the information
  • The various rights available to you in respect of such information

g) Data Accuracy: AINU Group and its Partners shall not be responsible for the authenticity or correctness of the personal information or sensitive personal data or information supplied by the User to AINU Group or any other person acting on behalf of AINU Group or its Partners.

h) Account Security: You are responsible for maintaining the confidentiality of your account access information and password if you are registered on the Website or App. You are responsible for all usage of your account and password, whether or not authorized by you. You must immediately notify AINU Group of any actual or suspected unauthorized use of your account or password. Although AINU Group will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of AINU Group or others due to such unauthorized use.

i) Information Accuracy: If you provide any information that is untrue, inaccurate, not current, or incomplete (or becomes untrue, inaccurate, not current, or incomplete), or AINU Group has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, AINU Group has the right to discontinue the Services to you at its sole discretion.

j) Usage of Data : Your data will be used for the following purposes:

  • To provide and improve healthcare services.
  • To communicate with you regarding your healthcare needs.
  • To process payments and manage your account.
  • To comply with legal and regulatory requirements.
  • You will contact us for providing medical and allied services only.
  • You agree that you will not submit any false or misleading information.

k) Storage of Data-We adhere to the following practices to ensure the secure storage of your data:

  • Data will be stored on secure servers compliant with applicable law.
  • Access to your data will be restricted to authorized personnel only.
  • Data will be encrypted to protect against unauthorized access.

l) Data Sharing and Disclosure

We may share your data with third parties only in the following circumstances:

  • With your explicit consent.
  • With healthcare professionals involved in your treatment.
  • To comply with legal obligations or court orders.
  • To protect and defend our rights or property.

m) Data Retention- We will retain your data for as long as necessary to fulfill the purposes outlined in this policy or as required by law. After this period, your data will be securely deleted or anonymized.

n) Contact Information: It is your responsibility to keep your correct mobile number and email ID updated on the Website or App. All reminders and notifications will be sent to the account associated with this mobile number and/or email ID. Every time you change any contact information (mobile or email), we will send a confirmation. AINU Group is not responsible for any loss or inconvenience caused due to your failure to update your contact details.

o) Customer Support: AINU Group and its subsidiaries and third party vendors may use information collected from Users from time to time for debugging customer support-related issues.

p) Communication Records: AINU Group may now or in the future provide Services where you may be able to converse with AINU Group, its authorized representatives, its doctors, or similar stakeholders via online chat, text messages, video calls, or voice calls. When you choose this option, the records of such conversations, calls, or exchanges may be recorded and stored on AINU Group’s or its Partners' servers. Such records are managed only in accordance with the Privacy Policy. AINU Group and its Partners accept no liability if you choose to use such a facility to interact with doctors or clinicians or if the facility is not used in accordance with the foregoing.

q) Personal Health Record:

  • Activation: This facility is only enabled or created for you after you have signed up and explicitly accepted these Terms.
  • Types of Information: Information in your Health Account is of two types:
    • Patient-created: Information generated and uploaded by you.
    • AINU-created: Information generated by consuming medical services at an AINU Group hospital, such as consultation, diagnostic tests, admission, etc.
  • Accuracy and Liability: Any AINU-created information is provided on an as-is basis and AINU Group makes no representation regarding its accuracy. You are solely responsible for the accuracy, adequacy, reliability, and liability of any Patient-created information. You fully indemnify and hold harmless AINU Group and its Partners regarding any inaccuracies, inadequacies, errors, losses, problems, liabilities, or other issues arising from any Patient-created information.
  • Reminders and Notifications: Any health-related reminder or notification service (e.g., medication reminders, appointment reminders) is only a supplementary way to notify or remind you of actions related to your health. AINU Group is not liable if a reminder or notification is not delivered, is delivered late, or is delivered incorrectly, despite our best efforts, or if your health is impacted negatively due to the same subject to adherence to applicable TRAI rules
  • Security: AINU Group uses industry-level security and encryption to protect your personal health record. However, we cannot guarantee prevention of unauthorized access if you lose your login credentials, or they are otherwise compromised. Please safeguard your login credentials and report any actual or suspected breaches of your account to contactus@ainuindia.com.
  • Dependents' Records: If you access your dependents’ records through your personal health record by registering your dependents with your account, you are deemed responsible for their records and all obligations they would have had if they maintained their own individual personal health record.
  • Third-Party Access: If you provide anyone else access to your personal health record, you are deemed responsible for all actions, access, and transactions related to your personal health record by that person. AINU Group or its Partners are not responsible or liable for any actions, transactions, losses, leakage, or other liabilities arising from this.

4. Listing Content and Disseminating Information

a) Content Accuracy: All content provided on the Website or App is for informational purposes only. While we strive to ensure the accuracy of the content, we make no warranties or representations regarding the accuracy or completeness of any information on the Website or App.

b) User-Generated Content: Users may post or upload content to the Website or App, including but not limited to reviews, comments, and feedback. By submitting such content, you grant AINU Group a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and display such content.

c) Content Moderation: AINU Group reserves the right to review, modify, or remove any content that it deems inappropriate or in violation of these Terms or applicable laws.

5. Booking Appointments

a) Appointment Scheduling: Users may book appointments with medical professionals through the Website or App. The availability of appointments is subject to the schedules of the medical professionals and the policies of AINU Group.

b) Cancellation and Rescheduling: Users must adhere to the cancellation and rescheduling policies provided at the time of booking. Failure to cancel or reschedule in accordance with the policies may result in penalties or charges.

c) No Guarantee of Availability: AINU Group does not guarantee the availability of specific medical professionals or appointment slots and may need to reschedule appointments based on availability.

6. Interaction with Medical Service Providers

a) Consultations: Users may interact with medical service providers through the Website or App via chat, video call, or voice call. These interactions are subject to the availability of medical service providers.

No Medical Advice Guarantee: Any advice or information provided by medical service providers through the Website or App is for informational purposes only and does not constitute professional medical advice. Users should consult their healthcare provider for personalized medical advice.

c) Record Keeping: Records of interactions with medical service providers may be stored by AINU Group in accordance with the Privacy Policy.

7. Online Payment on Website and App

a) Payment Processing: Users may make payments for Services, including appointment bookings, diagnostic tests, and medicines, through the Website or App. Payments are processed through secure third-party payment gateways.

b) Payment Security: AINU Group uses industry-standard encryption and security measures to protect payment information. However, AINU Group is not liable for any issues related to the payment process or for unauthorized transactions.

c) Refunds and Cancellations: Refunds and cancellations are subject to the policies provided at the time of the transaction. Users should review these policies before making a payment.

Customer Rights

You have the following rights regarding your data:

11.Content Ownership and Copyright Conditions of Access

The content on the Website includes user-generated material and content owned by AINU Group and its partners. All information collected by AINU Group from users, either directly or indirectly, is the property of AINU Group and its partners. Copying AINU Group's copyrighted content for commercial purposes or profit is a copyright violation, and AINU Group and its partners reserve the right to pursue legal action.

Users are authorized to view and access the content on the Website solely for purposes outlined in this Agreement, such as ordering, receiving, delivering, sharing, storing, and communicating. The content, including text, graphics, images, logos, software code, and design (collectively, "AINU Content"), is owned by AINU Group or its partners and is protected by copyright, trademark, and other laws. Users must not modify, reproduce, display, perform, distribute, or use AINU Content for public or commercial purposes or for personal gain.

Users are prohibited from accessing the Services to monitor their availability, performance, or functionality, or for benchmarking or competitive purposes.

12. Severability

The validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired if any provision of this Agreement is rendered void, illegal or unenforceable in any respect under any law. Should any provision of this Agreement be or become ineffective for reasons beyond the control of the Parties, the Parties shall use reasonable endeavors to agree upon a new provision which shall as nearly as possible have the same commercial effect as the ineffective provision.

13. Waiver

No waiver of any provision of this Agreement shall be effective unless it is in writing. A waiver shall be effective only for the purpose for which it is given. No default or delay on the part of any Party in exercising any rights, powers, or privileges operates as a waiver of any right, nor does a single or partial exercise of a right preclude any exercise of other rights, powers or privileges.

15. Governing law and Dispute Resolution -

If a dispute arises between the Parties, they will first seek to resolve it by meeting with the Financial Controller of the Hospital. In the event the dispute is not resolved within 30 (thirty) days, the client may reach out to the Chief Financial Officer (CFOs). In case of failure to resolve disputes, disputes shall be referred to a sole arbitrator, appointed by mutual agreement of the Parties, in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time. The arbitration will take place in Hyderabad, Telangana and the arbitrator's decision will be final and binding. The Arbitration proceedings will be in English.

16. Termination

AINU Group reserves the right to suspend or terminate a User’s access to the Website and Services, with or without notice, and to pursue any legal remedies available if:

  • The User breaches any terms of the Agreement.
  • A third party reports a violation of its rights due to the User’s use of the Services.
  • AINU Group cannot verify or authenticate any information provided by the User.
  • AINU Group suspects illegal, fraudulent, or abusive activity by the User.
  • AINU Group believes, at its sole discretion, that the User’s actions could create legal liability for themselves, other Users, AINU Group, or its partners, or are contrary to the Website's interests.

Once suspended or terminated, the User cannot access the Website using the same or a different account or by re-registering. Upon termination, the User will lose access to any data, messages, files, and other materials stored on the Website. The User is responsible for maintaining their own backup of any medical services rendered to comply with their record-keeping practices

17. Intellectual Property

All content on this website, including text, graphics, and images, is owned by AINU Group or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive license to access and use the content for personal, non-commercial purposes only. Any other use, including modification or distribution of the content, requires prior written consent from AINU Group. Trademarks displayed on this website are owned by AINU Group and cannot be used without permission.

User-submitted content remains your property, but by submitting it, you grant AINU Group a license to use, reproduce, and display it in connection with the website.   • I consent to receive marketing and important business-related information from AINU Hospitals through mobile app notifications, WhatsApp messages, email, call and SMS.
  • I understand that my personal data will be used in accordance with the Data Protection Act, 2023.

Having read and understood the points mentioned above, I consent to allowing the AINU Group to collect, use, share or process such personal data as may be necessary to above mentioned purposes. This consent shall supersede any preferences set through Do Not Disturb (DND Register)/ National Customer Preference Register (NCPR).

I understand that the terms of the AINU Group’s Terms and condition policy may change, and I will be notified of the same before or at the time any further collection, use or processing of my personal data takes place. I understand that I will be provided the opportunity to provide fresh consent for the same.

I understand that I have the right to revoke my consent at any time, and such revocation will not result in penalty or loss of benefits.
